    Solo Soles Seller Policy

    This Seller Policy applies to all users who list or sell items through the Solo Soles marketplace ("Solo Soles," "we," "us," or "our").

    By listing an item for sale, you agree to this Seller Policy, the Solo Soles Terms of Use, Prohibited Items Policy, Returns and Refunds Policy, Privacy Policy, and other applicable marketplace rules.

    Solo Soles is designed specifically to connect people who have an individual shoe they do not need with people searching for that particular shoe. Accuracy is especially important because every listing represents an individual LEFT or RIGHT shoe.

    1. Seller Eligibility

    To sell through Solo Soles, you must:

    • Be at least 18 years old;
    • Have legal capacity to enter into a binding agreement;
    • Maintain an active Solo Soles account;
    • Provide accurate identifying and contact information;
    • Own or be legally authorized to sell every item you list; and
    • Complete any identity, payment, tax, or payout verification required by Solo Soles or its payment provider.

    Solo Soles may require additional verification before permitting listings or releasing seller proceeds.

    2. Listing Fees

    Solo Soles currently does not charge a fee merely to create an ordinary listing.

    Listing is free. Solo Soles only gets paid when you do.

    Solo Soles reserves the right to introduce optional paid features, promotional listings, seller plans, or other services in the future.

    Any applicable fee will be disclosed before a seller agrees to incur it.

    3. Marketplace Commission

    When an item sells, Solo Soles currently charges a marketplace commission equal to:

    10% of the item's selling price

    Unless otherwise disclosed at the time of listing or sale, the marketplace commission does not include shipping or sales tax charged to the buyer.

    The seller dashboard should display before listing:

    • Selling Price;
    • Solo Soles Marketplace Fee;
    • Estimated Seller Proceeds; and
    • Any other applicable charges.

    Solo Soles may change marketplace fees prospectively upon notice.

    4. Left and Right Shoe Identification

    Correctly identifying the side of the shoe is one of the seller's most important responsibilities.

    Solo Soles uses the following standardized identification system:

    YELLOW + L + LEFT= LEFT SHOE

    RED + R + RIGHT= RIGHT SHOE

    Every seller must accurately identify whether the shoe being listed is a LEFT shoe or RIGHT shoe.

    Before publishing a listing, the seller will be required to confirm the selected side.

    Before shipping a sold item, sellers should verify the side again.

    Shipping a RIGHT shoe when the listing identified a LEFT shoe, or vice versa, constitutes an incorrect item and may result in a required return and full refund to the buyer at the seller's expense.

    5. Accurate Listings

    All listings must be truthful, complete, and accurate.

    Sellers must accurately disclose:

    • LEFT or RIGHT side;
    • Brand;
    • Model or style, if known;
    • Department or intended sizing category;
    • Shoe size;
    • Width;
    • Color;
    • Condition;
    • Material defects;
    • Significant wear;
    • Stains or discoloration;
    • Damage;
    • Alterations;
    • Missing components;
    • Whether an original box is included; and
    • Any other information that would reasonably affect a buyer's decision.

    Do not conceal defects.

    Do not describe an item as "new" if it has been materially worn.

    Normal minor differences in color caused by photography or device displays are not necessarily considered misrepresentation, provided the seller's photographs and description were reasonable and accurate.

    6. Photographs

    Photographs should show the actual shoe being sold.

    Sellers should provide clear photographs showing, where applicable:

    1. Outside of the shoe;
    2. Inside of the shoe;
    3. Sole or bottom;
    4. Size/manufacturer label;
    5. Toe and heel;
    6. Material wear or damage; and
    7. Any identifying model or style information.

    Sellers may not use photographs designed to create a materially misleading impression of the item's actual condition.

    Images belonging to another seller, manufacturer, photographer, or third party may not be used without authorization.

    7. Size and Fit

    The seller must accurately report the manufacturer's marked shoe size and width.

    Sellers should photograph the manufacturer's size label whenever reasonably possible.

    Sellers do not guarantee that an accurately listed shoe will fit a particular buyer.

    Fit can vary between brands, models, years, and individual users.

    A buyer's inability to comfortably wear an accurately listed shoe does not, by itself, establish that the seller misrepresented the item.

    8. Authenticity

    Only authentic merchandise may be sold.

    Counterfeit, replica, imitation, falsely branded, or otherwise infringing products are prohibited.

    By listing a branded shoe, the seller represents that the seller reasonably believes the item is authentic.

    Solo Soles may request information or photographs concerning authenticity.

    Listings may be removed and seller accounts restricted or terminated where Solo Soles reasonably believes merchandise is counterfeit or otherwise prohibited.

    9. Ownership

    You may only list an item that:

    • You own;
    • You have legal authority to sell; and
    • You have in your possession or control and can timely ship.

    Stolen merchandise is strictly prohibited.

    Do not list an item that you have already sold elsewhere unless the Solo Soles listing is immediately removed or deactivated.

    10. One Shoe Means One Shoe

    Unless a listing expressly states otherwise, a Solo Soles listing is for one individual shoe, not a pair.

    Sellers must not use photographs or descriptions that could reasonably cause a buyer to believe two shoes are included when only one is being sold.

    The listing must prominently identify the individual shoe being sold.

    11. Selling Price

    Sellers choose their fixed selling price subject to marketplace rules.

    Solo Soles currently operates as a fixed-price marketplace.

    There are no auctions or bidding during the initial marketplace launch.

    A seller may change the price of an unsold listing.

    Once a buyer completes payment, the seller must honor the agreed selling price unless the transaction is cancelled under an applicable Solo Soles policy.

    12. Completing a Sale

    When a buyer completes a purchase:

    • The listing will be marked SOLD;
    • The seller will receive notice of the sale;
    • The seller must prepare the item for shipment;
    • The seller must ship the exact item described in the listing; and
    • The seller must follow Solo Soles shipping requirements.

    A seller may not substitute a different shoe without the buyer's express agreement through Solo Soles and approval where required.

    13. Shipping Deadline

    Unless a listing specifies a shorter period or Solo Soles authorizes otherwise, sellers must ship sold items within:

    3 BUSINESS DAYS after confirmed payment.

    A seller who cannot meet the shipping deadline should promptly contact Solo Soles.

    Repeated failure to ship promptly may result in:

    • Order cancellation;
    • Refund to the buyer;
    • Loss of seller protections;
    • Lower marketplace standing;
    • Account restrictions; or
    • Suspension.

    14. Tracked Shipping

    Tracked shipping is strongly encouraged and may be required for marketplace protection.

    Where Solo Soles provides a shipping label, the seller should use that label unless otherwise authorized.

    Where sellers provide their own shipping, they may be required to enter a valid tracking number.

    Sellers must ship to the delivery address identified in the authorized Solo Soles transaction.

    Do not ship to a different address merely because a buyer requests it through a private message.

    15. Packaging

    Sellers are responsible for packaging items reasonably and securely.

    Packaging should protect the shoe from foreseeable damage during ordinary transportation.

    Where appropriate, sellers should protect footwear from:

    • Moisture;
    • Crushing;
    • Excessive movement; and
    • Contamination.

    A seller may be responsible for damage caused by materially inadequate packaging.

    16. Shipping Costs

    Unless otherwise displayed on the listing, the buyer pays the stated shipping charge.

    Shipping charges must not be intentionally inflated as a means of avoiding Solo Soles marketplace fees.

    If Solo Soles provides calculated shipping, the Platform-generated amount will apply subject to applicable adjustments.

    17. Seller Payouts

    Seller proceeds may be processed through a third-party marketplace payment provider such as Stripe Connect.

    The seller's estimated proceeds generally equal:

    Item Selling Price – Solo Soles Marketplace Fee – Other Applicable Seller Charges or Adjustments

    Seller proceeds may remain pending while a transaction is completed.

    Solo Soles or its payment provider may delay, hold, reverse, or offset seller proceeds when reasonably necessary in connection with:

    • Payment processing;
    • Identity verification;
    • Fraud prevention;
    • Shipment verification;
    • Delivery confirmation;
    • Buyer claims;
    • Returns;
    • Refunds;
    • Chargebacks;
    • Suspected violations;
    • Negative account balances; or
    • Legal obligations.

    18. Delivery and Inspection Period

    For purposes of Solo Soles marketplace protection, an order is generally considered delivered when the carrier's tracking information shows delivery to the buyer's transaction address.

    Buyers should inspect the item promptly.

    A buyer ordinarily must report a materially incorrect or misrepresented item within:

    3 calendar days after confirmed delivery

    unless a longer period is required by law or Solo Soles determines that circumstances reasonably justify additional time.

    Seller proceeds may remain subject to adjustment during this inspection period.

    19. Buyer Claims

    A buyer may potentially qualify for Buyer Protection if:

    • The item never arrives;
    • The seller sends the wrong item;
    • The seller sends the wrong LEFT/RIGHT side;
    • The seller sends a materially different size than listed;
    • The item is materially different from the listing;
    • Significant undisclosed damage exists; or
    • The item is counterfeit.

    Solo Soles may request photographs, tracking information, messages, listing information, or other evidence from either party.

    Sellers must reasonably cooperate with investigations.

    20. Wrong Side

    If a seller lists:

    YELLOW + L + LEFT

    and sends a RIGHT shoe, the seller is responsible for the error.

    If a seller lists:

    RED + R + RIGHT

    and sends a LEFT shoe, the seller is responsible for the error.

    Where the seller shipped the wrong side, Solo Soles may require:

    • Return of the item;
    • Seller-funded return shipping;
    • Full refund to the buyer; and
    • Reversal of the applicable seller proceeds.

    Repeated LEFT/RIGHT errors may result in account restrictions.

    21. Wrong Size or Width

    If the seller ships a shoe that differs materially from the size or width represented in the listing, Buyer Protection may apply.

    If the seller accurately listed and shipped the manufacturer's stated size and width but the shoe does not fit the buyer as expected, the seller is generally not responsible solely because of fit.

    22. Item Not as Described

    An item may be considered materially not as described when an important characteristic differs substantially from the listing.

    Examples may include:

    • Significant undisclosed damage;
    • Materially incorrect condition;
    • Wrong brand or model;
    • Wrong side;
    • Wrong marked size;
    • Counterfeit merchandise; or
    • Major undisclosed alteration.

    Minor subjective differences that do not materially affect the listing ordinarily will not qualify.

    23. Returns Caused by Seller Error

    When a return is approved because of seller error or a materially inaccurate listing, the seller may be responsible for reasonable return shipping costs.

    The buyer must generally return the same item received in substantially the same condition, except for inspection reasonably necessary to identify the problem.

    Once the required return has been completed, Solo Soles may refund the buyer and reverse or offset the seller's transaction proceeds.

    24. Buyer's Remorse and Fit

    Solo Soles Buyer Protection is not intended to guarantee that every shoe will fit every buyer.

    If the listing was accurate and the correct shoe was sent, the following ordinarily do not constitute seller error:

    • Buyer changed their mind;
    • Buyer ordered the wrong side;
    • Buyer ordered the wrong size;
    • Buyer dislikes the color;
    • Buyer dislikes the style;
    • Shoe does not feel comfortable;
    • Shoe fits differently than expected.

    A seller may voluntarily accept such a return if permitted through the Platform, but is not required to do so unless applicable law or the listing states otherwise.

    25. Cancellations

    A seller should not cancel a completed sale merely because:

    • The seller changed their mind;
    • The seller believes the item could sell for more;
    • Another buyer offered a higher amount; or
    • The seller wants to sell outside Solo Soles.

    Legitimate cancellation circumstances may include:

    • Item was materially damaged before shipment;
    • Listing contained a material error;
    • Item was previously unavailable because of an accidental inventory issue; or
    • Solo Soles instructs the seller not to ship.

    Frequent seller cancellations may result in account restrictions.

    26. Payment Outside Solo Soles

    Sellers may not use Solo Soles primarily to find buyers and then move the transaction off-platform to avoid marketplace fees or protections.

    Do not instruct buyers to pay through:

    • Cash apps;
    • Wire transfers;
    • Cryptocurrency;
    • Gift cards;
    • Direct bank transfers; or
    • Other outside payment methods

    for a transaction initiated through Solo Soles unless Solo Soles specifically authorizes that method.

    27. Communications with Buyers

    Communications must remain professional and relevant to the transaction.

    Sellers may not:

    • Harass buyers;
    • Discriminate against users;
    • Demand disclosure of medical information;
    • Ask why the buyer needs an individual shoe;
    • Solicit off-platform payments;
    • Send spam;
    • Threaten buyers; or
    • Retaliate against a buyer for making a good-faith claim.

    28. Medical Information

    A buyer's medical diagnosis or physical condition is generally irrelevant to the seller's responsibilities.

    Do not request medical proof as a condition of selling an ordinary shoe.

    Solo Soles is intended to make single-shoe purchasing easier without requiring users to explain or justify why they need one.

    29. Reviews and Ratings

    Buyers may rate sellers following transactions.

    Sellers may not:

    • Purchase or fabricate reviews;
    • Pressure buyers to leave positive reviews;
    • Retaliate for negative reviews;
    • Offer undisclosed compensation in exchange for favorable ratings; or
    • Create accounts to manipulate seller ratings.

    Solo Soles may remove reviews that violate marketplace policies.

    30. Refunds, Chargebacks, and Adjustments

    Where a transaction is refunded, reversed, charged back, or otherwise adjusted, Solo Soles may deduct the applicable amount from:

    • Pending seller proceeds;
    • Future seller proceeds;
    • Seller payment-provider balances; or
    • Other amounts payable to the seller,

    to the extent permitted by law and applicable payment-provider rules.

    31. Fraud

    Fraudulent activity is prohibited.

    Examples include:

    • Shipping an empty package;
    • Providing fraudulent tracking;
    • Misrepresenting an item;
    • Selling counterfeit merchandise;
    • Manipulating transactions;
    • Colluding with another user;
    • Creating false claims;
    • Using stolen payment information; or
    • Attempting to improperly obtain marketplace funds.

    Solo Soles may permanently suspend accounts and cooperate with payment processors or law enforcement where appropriate.

    32. Seller Records and Taxes

    Sellers are responsible for maintaining records and addressing their own tax obligations associated with marketplace income.

    Solo Soles or its payment provider may request tax information or issue required tax-reporting documentation.

    Solo Soles does not provide individualized tax advice.

    33. Prohibited Items

    Sellers must comply with the Solo Soles Prohibited Items Policy.

    Counterfeit, stolen, hazardous, illegally obtained, materially contaminated, or otherwise prohibited merchandise may not be sold.

    34. Enforcement

    Solo Soles may take reasonable action for violations, including:

    • Warning the seller;
    • Removing listings;
    • Cancelling transactions;
    • Holding payouts;
    • Refunding buyers;
    • Restricting selling privileges;
    • Suspending the account; or
    • Permanently terminating access.

    The action taken may depend on the severity, frequency, intent, and marketplace risk involved.

    35. Changes to This Policy

    Solo Soles may update this Seller Policy from time to time.

    The current version and "Last Updated" date will be posted on the Platform.

    Material changes will be communicated where required by law.
